GENERAL PROVISIONS

These rules (hereinafter – Rules) constitute an agreement between Dropstone, UAB, legal entity code 305652842, registered office address Girulių St. 10, 12123 Vilnius (hereinafter – the Seller) and you, under which the Seller will provide you with the opportunity to purchase the goods (hereinafter – the Goods) and gift vouchers (hereinafter – Gift Vouchers) offered in the online shop at http://www.donum.lt/ (hereinafter – the E-shop).

You have the right to purchase in the E-shop only if, under applicable laws, you are able to enter into a binding contract with the Seller, and only if you comply with these Rules and applicable laws. If you are under 18 years of age, you may purchase in the E-shop only with the consent of your parents or other legal representatives. By placing an order, you confirm that you are 18 years of age or older or have the consent of your parents or other legal representatives.

PURCHASING IN THE E-SHOP

When you visit the E-shop and select Goods, a cart is created based on that selection.

After creating your cart, you must enter the information necessary to deliver the selected Goods. Make sure that the information provided is correct and that the Goods ordered meet your requirements. You have the opportunity to correct any errors before confirming your order. The information you provide is processed for the purposes and in accordance with the procedure set out in the Privacy Policy.

You agree that by placing an order in the E-shop, you undertake to pay the price for the Goods specified in the order. The price of the Goods specified in the E-shop and in the order includes all taxes, but does not include the fee for delivery of the Goods, which you will have to pay additionally (unless otherwise stated in the E-shop). Prices in the E-shop and in the order are stated in euros.

You can pay for the Goods in the following ways: electronic banking, credit card, bank transfer, or cash. 

You can pay using the electronic banking services of Swedbank, SEB, Luminor, Citadele, Šiauliai, Medicinos, and Revolut banks, as well as credit unions. Payments can be made in euros. Payments are processed using the Paysera payment platform.

Payment must be made immediately after placing the order.

Once you confirm the order, the Seller receives all the information about it. The order is considered submitted from the moment the Seller receives it. In such a case, it is also deemed that a contract has been concluded between you and the Seller. However, the Seller is required to perform the contract only from the moment the Seller receives confirmation from the payment service provider that payment for the Goods has been made.

After an order is submitted, an email will be sent to the email address you provided, specifying the Goods ordered and the information you provided.

Upon receiving notification that you have paid for the ordered Goods, the Seller undertakes to fulfil your order. When the company cancels a consumer’s completed order on its own initiative, stating that the Goods ordered by the consumer are not in stock (or for other reasons), the money is refunded without undue delay rather than within 14 days.

This section of the Rules also applies to the purchase of Gift Vouchers.

CHARACTERISTICS AND QUALITY OF GOODS

The characteristics of the Goods are specified in the E-shop in the description of each item. The Seller seeks to ensure that the Goods comply with the requirements established by law and are suitable for their intended use.

By placing an order, you confirm that you have read and understood this and that the Goods specified in the E-shop may differ in colour, shape, or other parameters from the actual size, shape, and colour of the Goods due to the characteristics or settings of the monitor or other device you use. Such differences will not be considered defects in the Goods, except where the discrepancies are caused by the actions of the Seller or third parties associated with the Seller.

The dimensions of the goods provided in the E-shop may differ from the actual dimensions due to manufacturing and measurement tolerances. A tolerance of 1–3 cm is permitted. Such deviation is not considered a defect or error.

The Seller undertakes to transfer Goods that conform to the information provided in the description of the Goods in the E-shop. The Seller also undertakes to provide you with the assortment and quantity of Goods specified in the order, but is not liable where the assortment or quantity of the Goods delivered is inaccurate because you provided incorrect information in the order submitted to the Seller.

DELIVERY OF GOODS

When ordering Goods, you must specify the delivery address and contact telephone number for the Goods (if the Goods are delivered in Lithuania, the number must be registered in Lithuania). Delivery is available in the following ways: we deliver to VENIPAK parcel self-service terminals (parcel lockers) or pickup points, or to UAB "Omniva" parcel self-service terminals (parcel lockers) or via UAB “Omniva” couriers. The nearest Omniva parcel locker is selected automatically based on the postal code of your residential address (you do not need to choose the parcel locker yourself).

• Delivery cost abroad—from EUR 6.
• Free delivery—from EUR 50.*

*Does not apply to orders abroad and courier delivery.

We ship orders within 1–2 business days. From the day of shipment, orders are usually delivered:

• Lithuania within 1–3 business days.
• Europe within 5–9 business days.
• The USA and other countries within 7–14 business days.

Please note that the indicated delivery or collection times for Products are preliminary. Although we always strive to fulfill orders as quickly as possible, preparation may sometimes take longer due to a high volume of orders or the workload of delivery service providers. The Seller always provides information about the delivery status; please follow this information. Once the parcel has been shipped, you can track it using the parcel number in the delivery service provider's system.

If, upon receiving the Products, you notice that the parcel does not contain the ordered Product, inform the Seller immediately.

Products are delivered packaged according to their nature, to ensure that they are suitable for use for their intended purpose.

If you do not collect the parcel within 60 calendar days from the notification that it is ready for collection, the parcel will no longer be stored and the money will not be refunded.

EXCHANGE OR RETURN OF PRODUCTS

Withdrawal from the contract within 30 days (applicable only to consumers)

If you purchase from the E-shop as a consumer (i.e., a natural person acting for purposes unrelated to their business, trade, craft, or profession (consumer purposes)), you have the right to return Products or Gift Vouchers purchased from the E-shop (as long as they have not been used) within 30 (thirty) calendar days from the day you received the Product or Gift Voucher. You may do so without stating a reason (i.e., by exercising your right to withdraw from the distance contract granted to you by the legislation of Lithuania and the European Union).

If you withdraw from the contract, when returning the Product, it must be unused, with its labels attached and in its original packaging, undamaged and retaining its marketable appearance. We will consider this requirement fulfilled if, when trying out the Product, you have performed only those actions necessary to assess the Product and that you would normally perform when examining it in a physical store (e.g., trying on and inspecting the Product).

To exercise this right, you must notify the Seller no later than within 30 (thirty) calendar days from the date of receipt of the Product or Gift Voucher by email: info@donum.lt .

Having decided to withdraw from the contract, you must immediately, and in any event no later than within 30 (thirty) calendar days from the day on which you notified the Seller by email of the return, send the Products back to the Seller at Kalvarijų g. 125a, 08221 Vilnius, and, in the case of a Gift Voucher, permanently delete the Gift Voucher and its data. The deadline will be met if you send the Products before the 30 (thirty)-day period expires. You must cover the costs of returning the Products to the Seller.

If you withdraw from the contract, the Seller undertakes, no later than within 14 (fourteen) calendar days from the day on which you notified the Seller by email of the return, but not before the Seller receives the returned Product (unless the Seller decides at its discretion not to wait for the returned Product), to refund to the bank account you specified all money paid by you for the Product and its delivery to you.

Wholesalers and other purchasers who buy from the E-shop for purposes unrelated to consumption do not have the right to withdraw from the contract, unless otherwise expressly agreed with the Seller in writing.

Products of Unsatisfactory Quality

Products are covered by the statutory guarantee provided for under the laws of the Republic of Lithuania; that is, the Seller is liable to the consumer for any non-conformity of the Products with the quality requirements that existed at the time of delivery and became apparent no later than two years from the delivery of the Product.

If a Product purchased from the E-shop is of unsatisfactory quality, you have the right, in accordance with the procedures and within the time limits established by law, to request that the Seller repair the Product defects free of charge or replace the Product of unsatisfactory quality with a Product of suitable quality, and, in cases provided for by law, to request an appropriate reduction in the price or return the Product.

If you believe that a Product purchased from the E-shop is of unsatisfactory quality and have identified defects, you must notify the Seller by email no later than two months from the date on which the non-conformity was detected, informing the Seller of this and your preferred remedy. When reporting a Product of unsatisfactory quality, provide a detailed description of where and when the defect appeared, attach photographs of the Product and the defect, and provide any other relevant information that may help identify the defect. You may use the sample form provided here for Products of unsatisfactory quality.

The Buyer’s rights related to Goods of inadequate quality are exercised in accordance with the procedure laid down in Articles 6.364(1)–6.364(3) of the Civil Code of the Republic of Lithuania.

GIFT VOUCHERS

Gift Vouchers are valid for the period specified on them. The recipient of a Gift Voucher must use it in the Online Store, that is, use the Gift Voucher to pay for the Goods offered in the Online Store, within the period specified on the Gift Voucher. If the Gift Voucher is not used within the period specified on it, that period will not be extended, the Gift Voucher will become invalid, and the money paid for the Gift Voucher will not be refunded.

Attention! To care for the environment and promote sustainable consumption, we do not automatically add gift boxes to orders.

INTELLECTUAL PROPERTY

The trademarks and other marks used to identify the Goods and Gift Vouchers belong to the Seller and/or other persons and are protected by law. All intellectual property rights to the Goods and Gift Vouchers and their individual parts also belong to the Seller and/or other persons.

The trademarks and logos used in the Online Store, the domain name, the Online Store itself and the website on which it is hosted, as well as all their individual elements, including texts, photographs, drawings and all material contained in the Online Store and on the website, the layout, appearance and design of any page of the Online Store or website, and all intellectual property rights therein, belong exclusively to the Seller and/or other persons. You undertake not to copy, modify or otherwise use these intellectual property objects without the separate written consent of the rights holder.

LIABILITY

The Seller’s liability for the quality and delivery of the Goods is established by the applicable legislation.

You must provide the Seller with all the correct and complete information requested. You are responsible for providing the correct delivery address for the Goods.

CHANGES AND TERMINATION

The Seller may amend these Terms from time to time. The latest (current) version of the Terms will always be visible and accessible in the online store. Before confirming an order, you must familiarize yourself with the version of the Terms in force at that time. Each order will be subject to the version of the Terms that was in force when that order was confirmed.

The Seller shall have the right to discontinue (terminate) the operation of the online store at any time. Such termination shall not affect sale and purchase agreements in force at that time.

OTHER TERMS

These Terms and any sale and purchase agreement are concluded and must be interpreted in accordance with the laws of the Republic of Lithuania.

Any disputes, disagreements, or claims arising from or related to these Terms or an individual sale and purchase agreement, as well as matters concerning their breach, termination, or validity, shall be resolved in the courts of the Republic of Lithuania in accordance with the procedure established by the laws of the Republic of Lithuania. The entity for the out-of-court settlement of consumer disputes competent to resolve consumer disputes arising from these Terms is the State Consumer Rights Protection Authority (address: Vilniaus St. 25, LT-01402 Vilnius, tel. (8 5) 262 6751, email tarnyba@vvtat.lt; website address: http://www.vvtat.lt), or http://ec.europa.eu/odr/.

All notices or other communications related to purchases in the online store or these Terms will be sent by email (when sent to the Seller, to the email address specified at the beginning of the Terms; when sent to you, to the email address provided during the order process).

If any provision of these Terms is or becomes wholly or partially invalid, this will not affect the validity of the remaining provisions.
